CAN A FETUS BE MURDERED?

A private member’s bill in Ottawa would make it a serious offense (a minimum prison term of 10 years) for harming or causing the death of a fetus when committing an offense against the pregnant mother. The bill is called the “Unborn Victims of Crime Act” and it has now passed second reading.

Many groups opposed to the bill are concerned that it will put the whole issue of abortion back on the front burner in Canada. Gaetan Barrette, the president of the Quebec Federation of Medical Specialists says it is “clearly a manoeuvre to go in the direction of recriminalizing abortion.”

On the other hand, Luc Gagnon, president of Campagne Quebec-Vie says the bill is “a judicial and political question and I don’t see how medical specialists should get involved in this matter.”

Do you think the Criminal Code should try to protect a fetus when the pregnant mother is being physically harmed or murdered?

    The issue isn’t murder. It’s the killing of a fetus. Rather a biased headline there, Neil.

    A fetus can be killed. Is it fair that a woman can be deprived of her unborn child and not be given justice?

    No.

    It’s time we had a law.

    I would suspect most people would find the murder of a woman along with the fetus she is bearing is somewhat more heinous than the murder of the woman alone, as despiccable as that is. People are usually even more horrified to hear that a pregnant woman is attacked and battered in the area of the womb than a woman not pregnant, as despiccable as both events are. Such attacks are often made out of hatred for that fetus and what it represents.
    Maybe it is time we examined that sensitivity, aside from all the politically correct rhetoric.

    Abortion, by whatever name or under any circumstances is an abortion. We have decriminalized it in this country…and it should remain that way. Let’s not allow the Harper gang to recriminalize it through the back door. It is a moral choice best left to the individuals concerned. Even when the pregnant mother is dead there is a father somewhere and should the father be the murderer there are grandparents.
    As for Luc Gagnon’s comment on medical doctors the good man seems to ignore that in Quebec, and in most provinces I believe, abortions have to be vetted by a committee made of doctors and social workers. Should abortions be somewhat recriminalized, they would be the ones subject to criminal procedures and possible jail sentences. I guess they should be allowed a voice on the subject.
    However the abortion debate is an issue without resolution since you have two very strongly entrenched pressure groups none of them inclined to compromise. Just leave it at that and keep the legislators out of it.

    Paul, you’re about 20 years behind the times. The therapeutic committee system was struck down by the Supreme Court in 1988. That’s the famous “Morgentaler case”. You don’t need any committee whatsoever.

    Abortion, by whatever name or under any circumstances is an abortion. We have decriminalized it in this country…and it should remain that way. Let’s not allow the Harper gang to recriminalize it through the back door

    And what about the women and their families who lose their babies to crime? Just too bad for them?

    I think the pro-abortion side is being very callous in dismissing the loss of unborn children. It should be a crime.

    You are right Suzanne about the therapeutic committee system. However, although not in favor of abortion, I still defend the right of choice. I claim for others the freedom I claim for myself.

    Do you believe all human beings have the right to life?

    Freedom is circumscribed by the rights of others. Owning a uterus does not give a woman the right to kill the baby inside it.

    Define “equal.” Clarify the question; it’s much too vague.

    No. And that’s a different question entirely from whether or not a fetus is a human being.

    There is no “baby.” There is a fetus. A fetus is not a baby. The fetus has no right to be there if the woman does not want it. The uterus belongs to the woman. It’s hers to do with what she wants. If she does not want it occupied with a fetus, no one has the right to force her to have it occupied.

    Yowza! Would that everyone in the world strove to be so respectable! We would never have had any religious wars, jihads, pogroms, crusades, or any other bloody struggle to force one side’s ideals down the throats of the other side.
